1. Agreement to Terms

By purchasing, accessing, or using Track90, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. License Grant

Upon activating a subscription, you are granted a non-exclusive, non-transferable license to use Track90 for personal, non-commercial use during your active subscription period. This license:

Is for a single user only
Cannot be shared, resold, or transferred
Remains valid while your subscription is active
May be used on multiple devices owned by you

Customers who previously purchased a lifetime license retain that license and continue to have full access to all programs.

3. Payment Terms

Track90 is available as a subscription: $4.99/month or $42.99/year. Both plans include access to all P90X programs. Payment is processed securely through Stripe. Subscriptions renew automatically until canceled. Existing lifetime customers retain lifetime access.

4. Refund Policy

We offer a 7-day money-back guarantee. If you're not satisfied with Track90 within 7 days of purchase, contact us at support@track90.app for a full refund. After 7 days, all sales are final.

6. Acceptable Use

You agree NOT to:

Share your license with others or use it for commercial purposes
Reverse engineer, decompile, or attempt to extract the source code
Circumvent any security measures or access controls
Use the service to transmit harmful, illegal, or offensive content
Attempt to gain unauthorized access to our systems

7. Intellectual Property

Track90, including its design, code, and content, is owned by us and protected by copyright and other intellectual property laws. The workout programs tracked by this app may be copyrighted by their respective owners. Track90 is an independent tracking tool and is not affiliated with any specific workout program.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Track90 is provided "AS IS" without warranties of any kind
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the service in the prior 12 months
We are not responsible for any injuries or health issues resulting from exercise

9. Service Availability

We strive to keep Track90 available 24/7, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Your local data will remain accessible offline.

10. Termination

We may suspend or terminate your access to Track90 if you violate these terms. You may stop using the service at any time. Upon termination, your license ends but you retain any data stored locally on your devices.

11. Changes to Terms

We may update these terms from time to time. Continued use of Track90 after changes constitutes acceptance of the new terms. We will notify users of significant changes.

12. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of competent jurisdiction in California.
